ORIGINAL PURCHASE POLICY

1. Contract of Sale & Ownership

All purchases of original artwork made through oleksiihurinenko.com are subject to the execution of a separate written contract of sale. These terms reflect the ownership and intellectual property provisions of that contract.

  • Transfer of Ownership: Legal ownership of the artwork transfers to the Buyer only upon receipt of full payment.

  • Physical Ownership: Ownership is strictly limited to the physical object. The purchase does not include any rights to the image or the conceptual intellectual property.

2. Intellectual Property & Copyright

Oleksii Hurinenko retains all intellectual property rights, including copyright, moral rights, reproduction, licensing, and derivative rights.

  • The Buyer may not reproduce, distribute, publish, license, or commercially photograph the artwork, or create derivative works, without express written consent.

  • The artist reserves the right to use images of the artwork for promotional, archival, and publication purposes.

3. Provenance & Digital Certification

Each original artwork is registered on the Verisart blockchain.

  • The digital Certificate of Authenticity and the physical tamper-proof QR tag must remain with the artwork in the event of an approved resale or transfer.

  • The removal or alteration of the Verisart security tag voids the artwork’s verified provenance.

4. Risk, Logistics & Care

  • Risk of Loss: Risk of loss or damage passes to the Buyer once the artwork is collected by the specialized courier (e.g., Navis Pack & Ship).

  • Insurance: While we facilitate professional crating, insurance coverage during transit for international orders is coordinated individually with the Buyer.

  • Resale & Transfer: The artwork may not be sold, auctioned, or otherwise transferred without the artist’s prior written consent. Any authorized transferee must agree to be bound by these terms.

  • Conservation: The Buyer agrees to care for and preserve the artwork in accordance with professional conservation standards, protecting it from environmental damage (e.g., direct sunlight, extreme humidity).

5. Breach of Terms

Any breach of the provisions above constitutes a material breach of these Terms & Conditions. Oleksii Hurinenko reserves all legal and equitable remedies to protect the integrity of the work and the artist's rights.
